1. Acceptance of Terms

By accessing or using NuraStats ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and HOST SERVER SRL, a company registered in Romania, European Union ("we", "us", "our").

You must be at least 18 years of age to create an account and use NuraStats. By registering, you confirm that you meet this requirement.

2. Description of Service

NuraStats is a privacy-first web analytics platform that allows website owners to collect anonymised, aggregate visitor statistics without using cookies or storing personal data. The Service is provided on a subscription basis with a free tier available.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at office@nurastats.com if you suspect unauthorised access.

4. Plans, Billing, and Refunds

NuraStats offers a free plan and paid subscription plans billed monthly or annually. Prices are displayed in USD and are subject to applicable taxes.

• Free plan — available indefinitely with usage limits as described on the pricing page. No credit card required.
• Paid plans — payment is charged at the start of each billing period via Stripe. Subscriptions renew automatically unless cancelled.
• No refunds — because a functional free plan is always available, we do not issue refunds on paid subscriptions. You may cancel at any time; your paid access continues until the end of the current billing period.
• Plan changes — you may upgrade or downgrade at any time via the billing dashboard.

5. Usage Limits and Over-Limit Policy

Each plan has defined limits on monthly page view hits and the number of tracked websites. If you exceed your plan's hit limit in a given month:

• We will continue to track hits beyond your limit on a best-effort basis and will notify you by email.
• We reserve the right to throttle or pause tracking for accounts significantly over their limit if it affects service stability for other users.
• You are encouraged to upgrade to a plan that fits your traffic.

6. Acceptable Use

You may only use NuraStats for lawful purposes and in accordance with these Terms. You agree not to use the Service to track or support:

• Websites or services that facilitate illegal activity, including but not limited to fraud, harassment, or distribution of malware.
• Spam operations — websites whose primary purpose is the distribution of unsolicited communications.
• Scraping or data harvesting services that violate the terms of the sites being scraped.
• Any activity that violates applicable local, national, or international laws or regulations.

We reserve the right to determine, at our sole discretion, whether a use case violates this policy.

7. Prohibited Activities

You further agree not to:

• Attempt to reverse engineer, decompile, or extract the source code of any part of the Service.
• Resell, sublicense, or white-label the Service or represent it as your own product without our written permission.
• Use automated tools to artificially inflate traffic statistics.
• Interfere with the security, integrity, or availability of the Service or its infrastructure.
• Share account access with individuals outside your organisation for commercial benefit.

8. Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in abusive behaviour, or if your account poses a risk to the Service or other users.

You may delete your account at any time from the account settings. Upon deletion, your data will be permanently removed within 7 days as described in our Privacy Policy.

9. Uptime and Service Availability

We operate NuraStats on a best-effort basis. We strive for high availability but do not offer a formal Service Level Agreement (SLA) or guarantee any specific uptime percentage. Scheduled maintenance, infrastructure issues, or events beyond our control may cause temporary interruptions.

We are not liable for any loss or damage arising from service downtime or data unavailability.

10. Data and Privacy

Your use of NuraStats is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of data as described therein.

You are responsible for ensuring that your use of the NuraStats tracking script on your website complies with applicable privacy laws, including obtaining any necessary consents from your own visitors. Because NuraStats collects no personal data, no cookie banner is required for the NuraStats script alone — however, you remain responsible for your overall compliance posture.

11. Intellectual Property

All rights, title, and interest in and to the Service, including the NuraStats name, logo, software, and documentation, are and remain the exclusive property of HOST SERVER SRL. These Terms do not grant you any rights to our trademarks or intellectual property beyond the limited licence to use the Service as described herein.

Analytics data collected about your own website visitors is yours. We do not sell or share your analytics data with third parties.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that any specific result will be achieved.

13. Limitation of Liability

To the maximum extent permitted by applicable law, HOST SERVER SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Romania and applicable European Union regulations, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Romania. If you are a consumer within the EU, you may also have rights under the laws of your country of residence.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
